OUR RECENT VICTORY!
This case involves a mother whose four children, the youngest being just 3 years old, were maliciously and fraudulently taken by a violent criminal who lived in the same apartment complex. The mother, who we will call Mary, did not see her children for five years.
The facts of the case are as follows:
Mary is a soft-spoken, lovely woman with a gentle personality, so was no match for the dangerous neighbor who worked as a stripper.
The violent neighbor relentlessly pursued Mary's husband and became pregnant by him. The neighbor then became a raging, threatening menace so desperate to take the husband away from Mary; she attempted to stab Mary with a stiletto heel but stabbed the husband instead. Although no one died, Mary felt terrorized, helpless, and fell into a deep depression. Mary's family became very concerned for their sweet daughter and insisted she seek inpatient therapy for her depression.
While Mary was in treatment, the neighbor accused Mary of being a psychotic danger to her children and enticed Mary's husband and the children to move into her apartment. DVISR's investigation from treatment records proved that Mary's treatment was for simple depression, brought on by the neighbor's threats and antics, and not being able to see her children - not the psychosis the neighbor claimed.
By chance, someone at Mary's church recommended she contact DVISR, INC, our nonprofit for domestic violence victims.
DVISR assessed the situation and recommended an attorney with Federal Civil Rights training. What DVISR and the attorney's investigation revealed was more bizarre than anyone could have imagined.
The neighbor claiming to be Mary had filed a forged divorce petition. Then, impersonating Mary, the neighbor told the Judge that she had wanted a divorce, wanted her husband to have full custody of the children and wanted no spousal support because she had mental problems. Consequently, the Judge granted the Divorce on her terms, giving the husband full custody of the children.
Once the attorney disclosed the fraud to the court, the Judge rescinded the fraudulent Divorce and assigned a Reunification Therapy for Mary and her children to resume their relationship. The neighbor would not stand for the kids to be reunited with their mother and canceled all the children's appointments for Reunification Therapy. Again, DVISR stepped in to tear down the barriers to reunification that the bully neighbor was posing.
DVISR sent the husband a copy of the Court Order for Reunification Therapy, pointing out that should he not comply with the court order, he would be held in contempt of court and sentenced to jail. Potentially going to jail motivated the husband to gather the courage to stand-up the neighbor who he now lives with and take the kids to the Reunification Therapy.
As soon as the children saw their mother, they were overjoyed, as they wanted to be with their mommy.
Mary now has her four children back in her life. Mary and her children are healing from the violence and separation caused by the neighbor.
We at DVISR are overjoyed with the outcome and grateful to all the angels that contributed to our nonprofit, which funded the work that made this case a resounding success - undoing the fraud and reuniting a mother with her children.
